Terms and Conditions of Site Use

These terms and conditions apply to your use of this website. In this document, where the context permits, “we” refers to Macular Degeneration New Zealand, a registered charitable trust.
Unless otherwise specified these terms and conditions also apply to any other website social media site or account of ours.
If you visit or interact with this site, or any other such site or account, in any way these terms and conditions automatically apply, unless we otherwise agree in writing.
These terms and conditions apply as at the effective date recorded above.
They may be amended from time to time or may be withdrawn or replaced.
Information and privacy.
1.1 If you access this site and supply personal information you must do so lawfully and you are responsible for the information you supply. You agree only to supply information which is accurate and not misleading.
1.2 If you are representing an organisation then you warrant that you have authority to do so and you are personally responsible to ensure the accuracy of information supplied.
1.3 We have a privacy policy which is found here. This policy applies to all personal information which we hold about you.
2. External links.
2.1 From time to time this site might include links to other websites, social media sites or similar platforms. We cannot control these sites and we have no responsibility for your experience when you access them. If you supply information to another site, you must ensure that they have suitable processes in place to protect your information.
3. Content and Unsolicited ideas.
3.1 We own and have an absolute right to control all content which we have contributed to this site.
3.2 We do not as a general rule publish or accept on this site any unsolicited content from persons not representing MDNZ or otherwise authorised to provide it. You should therefore not post any content or materials on this site. However, if we have invited user generated content on this site any comments or materials published by you must comply with all relevant laws and they must be your own comments and materials. They must not be defamatory. We reserve a right to take down or remove unsuitable content or materials, however we are not liable to you or anyone else if we do not do so. You will indemnify us and hold us harmless from any loss or costs arising from a third party claim due to any content or materials you have published on this site.
4. Opting out and unsubscribing.
4.1 Our marketing communications may contain an option to unsubscribe from future communications.
4.2 If you would like to opt out of receiving marketing messages you may use the unsubscribe link contained in the messages you have received from us, or alternatively you can contact us at info@mdnz.org.nz or phone 0800 622 852.
5. Governing Law, Implied Conditions, Illegal Conditions.
5.1 Where any provision in these terms and conditions requires interpretation or where any dispute arises the Laws of New Zealand will apply, and where a dispute or difference is to be determined by judicial process it will be determined by a New Zealand Court. Accordingly, for these purposes you agree to submit to the non-exclusive jurisdiction of the Courts of New Zealand.
5.2 If any provision of this document, or any other agreed term, is deemed unenforceable or illegal by a court of law with jurisdiction to do so, such provision will not apply or alternatively may be modified by the court, but only to the extent required to prevent the illegality or unenforceability whilst leaving the remaining provisions fully enforceable as they are written.
6. Intellectual Property and Trademarks.
6.1 We own all proprietary and intellectual property rights in this site and its content, including but not limited to copyright in text, graphics, logos, icons and sound recordings and also the underlying software and other materials. You may not without our prior written consent, in any form or by any means:
a. adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of this site; and/or
b. commercialise, copy or on sell any information or items obtained from any part of this site.
